*In the following documentation, ‘Collins Creations 3D Ltd.’ is referred to ‘CC3D’ for ease of use.

TERMS OF USE

Client’s use of the CC3D website, any content and any information provided by the Client including names, passwords, addresses, e-mail addresses, phone numbers, financial information (such as credit/debit card numbers), or information related to CC3D staff members transmitted in connection with the CC3D website is limited to the functionality of the CC3D website. In no event may the CC3D website be used in a manner that (a) harasses, abuses, stalks, threatens, defames, or otherwise infringes or violates the rights of any other party (including but not limited to rights of publicity or other proprietary rights); (b) is unlawful, fraudulent, or deceptive; (c) provides sensitive personal information unless specifically requested by CC3D; (d) includes spam or any unsolicited advertising; (e) uses technology or other means to access CC3D content that is not authorised by CC3D; (f) uses or launches any automated system including without limitation, robots, or offline readers, to access CC3D or Content; (g) attempts to introduce viruses or any other computer code, files, or programs that interrupt, destroy or limit the functionality of any computer software, hardware, or telecommunication equipment; (h) attempts to gain unauthorised access to CC3D computer network or user accounts; (i) encourages conduct that would constitute a criminal offence or that gives rise to civil liability; (j) violates these Terms and Conditions and Privacy Notices; (k) attempts to damage, disable, overburden or impair CC3D’s servers or networks; (l) impersonates any person or entity or otherwise misrepresents your identity with another person or entity; or (m) fails to comply with applicable third-party terms. COLLINS CREATIONS 3D Ltd. reserves the right, in its sole discretion, to terminate any Client participation on the CC3D website, remove content, or assert legal action with respect to Content or use of the CC3D website, where CC3D reasonably believes is or might be in violation of these Terms and Conditions and Privacy Policies. CC3D’s failure or delay in taking such actions does not constitute a waiver of its rights to enforce these Terms.

GENERAL

COLLINS CREATIONS 3D Ltd offers manufacturing services and digital data acquisition services through this website and through direct contact with COLLINS CREATIONS 3D Ltd. (“CC3D”) members of staff. In order to use these services provided by the CC3D website or through direct contact with CC3D staff members you need to be of legal age to make a binding contract or should be represented by a guardian of legal age and acceptable affiliation when requesting or being provided with CC3D services. By requesting CC3D services or placing an order, you are (a) offering to purchase a product; (b) representing that all information you provide to us in connection with such an order is true and accurate and you are an authorised user of the payment method provided. The receipt of a client of an order does not constitute our acceptance of an order. We retain the right to refuse any order made by a client.

Prior to acceptance of an order, verification of information may be required. CC3D reserves the right at any time after receipt of your order to accept, modify or decline your order, or portion thereof, even after your receipt of an order confirmation from CC3D, for any reason whatsoever. We reserve the right to limit the number of items ordered and refuse service to a client without notification. In the event that a product or service lists an incorrect price, either due to typographical or other error, CC3D shall have the right to refuse or cancel any such order placed for the incorrect price, regardless of whether the order is being or has been processed. If payment has already been made or if a client’s account has already been charged for the purchase and the order is cancelled, CC3D will refund any incorrect charges incurred.

ORDERING PROCESS- 3D PRINTING SERVICE

To order a print you first upload your file on the COLLINS CREATIONS 3D Ltd website; choose material, colour and post process finishing options and optional extras. Once the model has been checked for manufacturability you will be contacted momentarily and will be able to proceed with choosing the best delivery option for you.

COLLINS CREATIONS 3D Ltd reserves the right to discontinue those orders that do not meet our technical guidelines outlined in the DESIGN SMARTER-3D PRINTING NEED TO KNOW page of the COLLINS CREATIONS 3D Ltd website.

Orders containing firearms, weapons and their components will be rejected, however for the purpose of cosplay, props or toys COLLINS CREATIONS 3D Ltd will determine the suitability of printing such items upon receiving an explanation of the item’s intent from the client.

Orders containing obscene or graphic imagery and/or objects will be judged by COLLINS CREATIONS 3D Ltd after an explanation of such imagery and/or objects has been given by a client.

COLLINS CREATIONS 3D Ltd understands that there is a fine line between artistic influences and obscenity, but we strive to be transparent and non-judgemental regarding art and expression in all forms.

COLLINS CREATIONS 3D Ltd reserves the right to discontinue those orders that do not provide justified explanations for potentially obscene and/or weaponizable objects or imagery.

Products to be 3D printed that are larger than 500mm x 500mm x 500mm will need to be printed in more than one piece. These pieces can be assembled following printing and presented with minimal disruption to the overall model’s aesthetics however, some properties such as strength and durability may be significantly reduced. Alternatively, CC3D can therefore print objects smaller than this volumetric limitation in one single piece.

Optimised object orientation within the set volume may incur overall volumetric increase, which CC3D shall inform clients of before commencing all manufacturing processes.

ORDERING PROCESS- 3D SCANNING SERVICE

To order a print you first upload your file on the COLLINS CREATIONS 3D Ltd website; choose material, colour and post process finishing options. Once the model has been checked for manufacturability by our instant quoting system you will be able to select the best delivery option for you, checkout and complete your purchase.

For CORNWALL based clients EXCLUSIVELY, a face to face consultation and delivery service option is available where a meeting will be established to discuss and help develop your designs. Based on the information provided we shall then check your designs for manufacturability before proceeding to print your designs. You can then choose your preferred delivery method.

CC3D reserves the right to decline 3D Scanning services if the Design Smarter Guidelines are not followed or understood by clients, where requested object(s) specific suitability to 3D scan is not possible due to the properties of said object. The same applies to unsuitable locations where ambient lighting is insufficient for accurate and responsive scanning purposes. In circumstances where object or environmental factors may be unsuitable, CC3D staff will suggest alternate options to help a achieve client goals. If these alternate options are unacceptable for the client, then CC3D reserves the right to terminate future proceedings with said client on the project in question.

 

ORDERING PROCESS- PRODUCT ENHANCEMENTS

Custom Bases are optional extras that can be requested to help display and protect 3D models. The size of each bespoke base is optimised for the size of the 3D model ordered. They can be ordered with or without a Custom Name Tag. They can be ordered with or without matching Acrylic Covers. There are 3 size options available: 150mm x 150mm, 300mm x 300mm and custom.

Acrylic Covers are optional extras that can be requested to help display and protect 3D models. They are all 5 sided. They are limited to 3 volumetric categories: 150mm x 150mm x 150mm, 300mm x 300mm x 300mm and custom. These must compliment and match the size of the custom bases requested to provide a safe and secure fit.

Custom Text/Name Tags are limited to a limited number of characters per custom name plate. The character limit is restricted by the size of the display box ordered. There are three standard character limitation values determined by the three sizes of display box available: 150mm x 150mm, 300mm x 300mm and custom. Each character limited is listed in the order form listings. Choice of text should not include profane or offensive language and should consider font complexity before making a request/order.

Display bases and Acrylic Covers should be large enough to contain the entire model within. CC3D shall inform you if you have requested a size to small for the model requested. For example, a 3D printed model of dimensions 100mm x 60mm x 114mm would be suitable for a 150mm x 150mm x 150mm display box however a 170mm x 60mm x 114mm would not be suitable for this sized display box.

 

ORDERING PROCESS- DESIGN CONSULTATION SERVICE

Online consultation service appointments are available to all United Kingdom based residents. Here a timeslot will be made available for both clients and CC3D staff to converse freely over the telephone, email or digital messaging options. Appointment timeslots will be booked in advance and agreed upon via email confirmation request. Appointments provide clients and CC3D staff the opportunity to discuss and help develop designs, concepts and strategize toward prototype and product manufacturing. Designs and plans can be sent remotely and interpreted to the best of CC3D staff ability. CC3D shall follow-up with queries and suggestions to help bring client’s ideas and products to life using their preferred method of indirect contact.

Based on the information provided, CC3D shall then check client designs for manufacturability before proceeding to process client manufacturing and service requests.

Face to Face consultation service appointments are available to clients who live or whose businesses are in Cornwall. Here an appointment slot will be booked following initial contact with CC3D. Appointed meeting places and times will be booked using an email confirmation message. Appointments provide clients and CC3D staff the opportunity to discuss and help develop designs, concepts and strategize toward prototype and product manufacturing, in person at a location suitable fit for purpose. Follow-up meetings can be booked, or indirect contact can be continued throughout the consultation process.

Based on the information provided, CC3D shall then check client designs for manufacturability before proceeding to process client manufacturing and service requests. Clients can then choose their preferred delivery method, with the added option here to have Cornish clients receive their objects in person with a CC3D staff member.

Face to Face consultation meetings are currently exclusive to the county of Cornwall.

Upon establishing a new project with a client, CC3D will request a formal Non-Disclosure-Agreement to be signed and documented for all parties included in a project where Intellectual Property requires security and privacy. CC3D considers NDA completion mandatory and reserves the right to cease actions with clients who refuse to sign NDA forms.

 

SPECIAL EVENTS AND WEDDINGS PROCESS

Special Events Or Wedding Arrangements

The details of Special Events and Wedding arrangements are to be agreed beforehand in writing (email is acceptable). The Client shall notify CC3D of any changes to these details in writing. CC3D staff members cannot be held liable for delays or disruption in their delivery of the service until any changes are received and acknowledged in writing.

Cancellation

The Client may cancel the Service request at any time by giving written notice to CC3D but in doing so shall forfeit any costs incurred from services, consultations or products already rendered already. Cancellation less than 6 weeks before the special event or wedding will result in the payment in full becoming due. All cancellations must be in writing.

Retouching / Editing

All 3D Scans will be adjusted for brightness, noise, sharpness/resolution, surface smoothing, gaps in collected data and unwanted deformities etc. CC3D staff’s judgement regarding these corrections and the number of Scans required for the Client to undergo shall be deemed correct. Retouching, digital manipulation and artistic finishing is available to the Client as an option upon request. Such requests can be made directly in hand-written order form or on the online order form version.

Prints / Reorders

All singular 3D prints produced per individual Client at special events or weddings shall be treated as part of the total service. The price is fixed per contract. Clients have the right to request reorders, however this is not part of the initial contract and will incur additional costs. No responsibility for error will be accepted unless orders are given in writing.

Copyright

The copyright Designs and Patents Acts assign the copyright of the 3D data to CC3D. Any images or copies of images whether stored digitally or otherwise and any computer program including any source or object code, computer files or printed documentation relating to such point cloud data sets are protected by the Copyright and Design Act 1988. It is contrary to the Act to copy or allow to be copied digitally or by any other means an image or rendered 3D model created as part of this contract without the permission of CC3D in writing.

Licence

CC3D staff shall be granted artistic licence in relation to the poses scanned and the locations used. CC3D staff’s judgement regarding the locations/poses and number of scans taken shall be deemed correct. Due to the requirements of 3D scanning technologies and the willingness of subjects it may not be possible to capture all 3D scans as expected.

Force Majeure

The due performance of a contract is subject to alteration or cancellation by either party owing to any cause beyond their control. Although all equipment is checked regularly and reasonable steps are taken to ensure backup equipment is available, CC3D will not be responsible for 3D scans that are not produced due to technical failure.

Attendance

In the unlikely event of the assigned CC3D staff member being unable to attend the special event date or wedding due to unforeseen circumstances, we reserve the right to appoint another CC3D staff member (If possible) to attend your wedding on our behalf to undertake the special event or wedding 3D scanning experience to his/her best ability.

Personal Accident

Any directions issued to clients, their guests or employees during a 3D scanning appointment/session are deemed to be at said persons own risk. The CC3D staff member cannot be held responsible for any personal accidents during a 3D scanning session.

Any person who wishes to have a 3D scan of themselves or any person in the vicinity of an active, live or light emitting 3D scanner will need to sign a disclaimer stating that they are aware of the risks of exposure to 3D scanning technologies. CC3D reserves the right to refuse any individual person(s) who does not sign said disclaimer and will be required to leave the immediate visible range of an active, live or light emitting 3D scanner owned by Collins Creations 3D Ltd. CC3D does this with our clients health and safety in mind.

 

ONLINE STORE

CC3D does its best to ensure that information on the CC3D website is complete, accurate and current. Despite its efforts, however, information on the CC3D website may occasionally be inaccurate or out of date. All specifications, products, descriptions and prices of products on the CC3D website are subject to change at any time without notice. CC3D makes all reasonable efforts to accurately display the attributes of its products, including the applicable colours. However, the actual colour a client sees on the CC3D website is dependent upon the computer system being used and ambient lighting whilst observing the screen, CC3D cannot guarantee client hardware accuracy to display colour accurately.

The inclusion of any product or service on the CC3D website at a particular time does not imply or warrant that these products or services will be available at any time. We reserve the right to discontinue any product or service at any time.

CC3D accepts Visa Debit and Visa Credit cards for online purchases from the Online Store.

PAYMENT AND PRICE

The price quoted is broken down into manufacturing services, labour and shipping costs depending on circumstances and Client requests. Depending on what services Clients choose CC3D to facilitate, this will determine the final quote. Please see SERVICE PRICE LIST page for details. COLLINS CREATIONS 3D Ltd reserves the right to change its prices without notice.

Payment must be made in full and received by COLLINS CREATIONS 3D Ltd to start production on all stock items that can be purchased in the Online Store OR if organised directly with a CC3D staff member either directly (Face to Face) or through email, telephone or digital messaging, we commence manufacturing client projects immediate by introducing said project into CC3D’s manufacturing workflow and upon delivery provide an invoice of all costs incurred from all production and services rendered.

Payments for stock items can be made directly and securely via the CC3D Online Store which requires a credit/debit card. CC3D does not accept PayPal currently.

All CC3D Products and CC3D Services rendered as well as Invoices issued can be paid directly in person with our POS app provided by iZettle and portable credit/debit card reader.

Invoice payments can be made through email receipts that lead to our POS app provided by iZettle. Secure payments can be made using credit/debit card. CC3D expects clients (both individuals and businesses) to pay in full within the agreed upon 30 day period following the issue date of the invoice. We do not currently charge late fees, but CC3D reserves the right to restrict future business with unreliable clients or CC3D may introduce late-fees or add interest penalties to invoice orders, at a later date. For now, penalty fees such as the aforementioned are not in affect. Refusal of a client to pay fees and costs incurred through utilisation of CC3D services will render this client ‘blacklisted’ from future services; in these circumstance CC3D has full rights to refuse its services to this client(s) in future.

Payment methods can be agreed before commencing production if the circumstances favour one or more of the methods above.

Receipt of payment(s) made to CC3D for Products and Services rendered will be issued via e-mail correspondence upon CC3D receiving payments due. The same applies to Invoices being paid in full, receipt of Invoice payments will be sent via e-mail correspondence upon CC3D receiving said payment.

Clients are requested to check the CC3D Terms and Conditions before confirming orders or making payments.

CC3D REWARD SCHEME

CC3D provides a reward scheme for all customers who purchase CC3D products and services over particular threshold values. This reward scheme is referred to as the ‘CC3D Reward’ or ‘CC3D Reward Tokens’ in both digital and paper literature.

The three rewards (Mega, Giga and Tera) represent three reward tiers that CC3D customers are offered after purchasing CC3D products and services above three set threshold values. The value of all three ‘CC3D Reward Tokens’ is listed in both paper and digital pricing lists. Value of these rewards are subject to the continuity of the scheme, however recipients of ‘CC3D Reward Token’ in circulation, are guaranteed the value of the tokens they have on their person or their business possession. Proof of ownership of a ‘CC3D Reward’ is through delivery of a proprietary ‘CC3D Reward Token’ or associated online Discount Code assigned to each ‘CC3D Reward’ available, depending on the value threshold reached by a customer’s purchase.

Acquisition of the ‘CC3D Rewards’ can be accomplished through online orders placed on the CC3D ‘Online Store’ or through direct purchase (face to face) using the CC3D POS application service. In each instance, a customer who purchases one or more items and reaches one of the three value thresholds will be automatically provided with the ‘CC3D Reward’ corresponding to the value threshold reached per transaction. Thresholds are listed in digital and paper literature. A single purchase can only result in being rewarded with a single ‘CC3D Reward Token’. ‘CC3D Reward Tokens’ cannot be stacked whilst making a single transaction with Collins Creations 3D Ltd.

Alternatively, ‘CC3D Reward Tokens’ can be purchased as standalone items at the value stated in both digital and paper literature. These can be gifted to third parties if so desired.

The ‘CC3D Reward’ lasts indefinitely to all who possess a proprietary ‘CC3D Reward Token’. Providing a discount code alone, will not be considered proof of having received or purchased a ‘CC3D Reward Token’. Only a physical ‘CC3D Reward Token’ will be accepted as proof. Proof of discount ownership is only accepted by direct ownership of a physical ‘CC3D Reward Token’ that provides the owner with a guarantee discount (equivalent to the ‘CC3D Reward’ tier possessed) from all future CC3D product or service purchases.

Upon using a ‘CC3D Reward Token’ a client is to return the token back to CC3D. CC3D are happy to collect used tokens; this is most likely to be done face to face. A ‘CC3D Reward’ is to be only used once per client. This use of ‘CC3D Rewards’ is monitored by CC3D for individual clients. Clients cannot stack multiple ‘CC3D Reward Tokens’ together when making a single purchase (only one token will be accepted per transaction).

‘CC3D Rewards’ are not refundable nor can be replaced with recognized currency.

If a client is found acting fraudulently when using the ‘CC3D Reward’, then they shall be discounted from the ‘CC3D Reward’ scheme and potentially reported to the necessary authorities.

CC3D promise to fulfil the ‘CC3D Reward’ scheme, if all the above is abided by and understood.

SHIPPING AND DELIVERY

The average time required to produce and package a bespoke model is 2-3 working days on average. These are and remain ESTIMATES and NOT GUARANTEED. Additional time may be required if optional extras are added to orders, such as bespoke display cases or duplicate prints being manufactured, this may increase production time up to an average of 5 working days. If Third Parties are used in data acquisition or product development who experience delays themselves, this may incur delays in CC3D delivery dates. CC3D shall inform clients of such potential delays.

Your order will be delivered to the shipping address provided during the purchase of the service on the COLLINS CREATIONS 3D Ltd website or via a correctly completed written order form. COLLINS CREATIONS 3D Ltd is not liable for any delay, damage or cost caused by the delay in shipping or delivery. In circumstances where COLLINS CREATIONS 3D Ltd has performed site to site consultations, delivery of products may be done directly upon request from an individual client, in these circumstances alone will COLLINS CREATIONS 3D Ltd be liable for delays, damages or costs caused by a delayed delivery time. Face to Face consultation clients who requests personal delivery are EXCLUSIVELY limited to the county of CORNWALL.

In the case of Digital Content alone being distributed to clients, this can be delivered remotely via email correspondence. Digital content will be emailed to the pre-established e-mail address provided to CC3D upon initial contact with CC3D or through both digital and hand-written order forms.

RETURNS AND REFUNDS

As the products are printed based on your specifications, there is no right to return or possibility of cancelling your order after the purchase has been completed.

Upon delivery of the parts, we expect you to thoroughly examine the product/products. If upon inspection you feel the product is not conform with the order placed, then you should contact us within 14 days after your receipt of the product.

We are not responsible for the design of the product and we will not accept returns unless all the design guidelines on the DESIGN SMARTER Information Guides have been respected and the product is clearly different from the original design and/or presents quality defects.

COLLINS CREATIONS 3D Ltd does not consider quality defects clearly stated in the DESIGN SMARTER Information Guides which are characteristics intrinsic to the FDM manufacturing process; these issues should be avoided in the design stages. If they are unavoidable design traits of the requested project, then CC3D will re-orientate your product prior to printing to avoid blemishes and artefacts that would otherwise be unavoidable.

DO NOT return products without having first consulted a COLLINS CREATIONS 3D Ltd staff member and received an explicit request from COLLINS CREATIONS 3D Ltd to do so.

In the case where a return is necessary, there are labels included with each physical delivery to assist clients in sending packages back to CC3D.

Postage and packaging will be reimbursed following receival and inspection of the products in question.

If following inspection, the product is deemed unsatisfactory, CC3D shall offer a free re-print to overcome any problems expressed in the previous iteration received by the client. This free offer will not be automatic and will be offered to a client following the investigation of the faulty product. The client has every right to not proceed with this option if they so wish.

If following inspection, the product is deemed satisfactory and has been designed and manufactured with all DESIGN SMARTER Information Guides being used to their fullest extent, then CC3D will discuss possible options for the Client to take to achieve their goal(s).

Full Refunds will be extended to clients who do not wish to proceed with our manufacturing services. COLLINS CREATIONS 3D Ltd. is not responsible for outcomes following Consultation services and as such does not provide refunds for time spent with clients.

INTELLECTUAL PROPERTY

With the utilisation of the COLLINS CREATIONS 3D Ltd services you confirm that you are the rightful owner of the design or that you have obtained explicit permission from the original owner to submit the order to this service.

For individuals or businesses that do not wish to disclose details on their designs or projects before engaging in a working relationship with COLLINS CREATIONS 3D Ltd, this is not a problem. We are happy to send (via email) a set of Non-Disclosure-Agreement forms, that we issue to all our clients who require services in 3D Scanning, 3D Printing and Design Consultation. Unless contractually permitted, IP will remain the sole property of the client, ad infinitum.

All images, texts and contents present on the website are sole property of COLLINS CREATIONS 3D Ltd. By submitting your designs to our service, you agree to COLLINS CREATIONS 3D Ltd using your name and logo royalty free for its own marketing material.

LIMITATION OF LIABILITY DISCLAIMER

All information and content obtained through the website are provided “as is” and without warrant of any kind. COLLINS CREATIONS 3D Ltd will not be liable to any user or third parties for any direct damages, lost profits, physical or psychological injuries, contracts, business opportunities, loss of income, revenue, data, time or goodwill caused by our products or services.

Our liability is limited to the maximum extents permitted by UK law.

Under no circumstances COLLINS CREATIONS 3D Ltd can be held liable for any product defects which have been requested and analysed during the quotation phase.

**Special Case- Coronavirus (COVID-19) Personal Protection Equipment (PPE)**

This relates to all products and services issued by Collins Creations 3D Ltd, that have been labelled as personal protective equipment or wearables. These item are worn at the wearer’s own risk and no liability for any damage (physical, mental, physiological, health or financial) is accepted by the manufacturer or by any agent of, or on behalf of the manufacturer. Whilst all CE markings for the development and sale of PPE were declared ‘unrequired’ by UK government in 2020, during the period of the COVID-19 outbreak, Collins Creations 3D does not accept any liability for any faults in PPE products sold, delivered or manufactured, as stated previously. This point will remain so until determined by a revision in UK government policy and law.

LINKS TO OTHER WEBSITES

The CC3D website may contain links to third-party websites (“Other Sites”) that are not under COLLINS CREATIONS 3D Ltd.’s control. CC3D makes no claim and accepts no responsibility regarding the quality, nature or reliability of the Other Sites that are accessible by hyperlinks from the CC3D website or link to the CC3D website. CC3D provides these links as a convenience and the inclusion of any link does not imply endorsement by CC3D of Other Sites or any association with the operators of such Other Sites. You are responsible for viewing and abiding by the privacy statements and terms of use posted at any third-party site.

CC3D reserves the right to change this Privacy Policy and will post any revisions on its website.

2. What We Collect

2.1. When you register on the Website to create a CC3D account or subscribe to our email service, we ask for the following personal information in order to create an account for you:

Your first and last name.

Your email address.

Additional personal information, such as an avatar/profile picture can be voluntarily submitted by you in your account details.

If you want to use the Services offered by us, for example placing an Order or register as a Supplier, you may also be required to provide the following additional personal information:

Your billing information.

Your shipping information.

Your phone number.

Your tax registration number.

2.2. When using our Services you may exchange private messages (including, but not limited to text, images, videos, locations, contact details) with other users. These messages will be stored by CC3D in order to be able to deliver them to the intended recipient(s).

2.3 We also collect “Automatically Generated Information” about your behaviour during your use of the Service. This information may include IP addresses, type of browser, browser settings, date and time, what features your use and for how long and other information regarding your use of the Service. We may also collect this information by using “cookies” in accordance with Clause 6 of our Privacy Policy.

3. How We Use your Information and On What Grounds We Use It

3.1. Any personal information provided by you on the Website will be used for providing the Services to you and to facilitate any communication between you and other Users on the Website. If you pay an Order as a Customer, your first and last name, phone number and shipping address will be shared with the Supplier.

3.2. If you register as a Supplier, your first name and the approximate location can be disclosed on the Website. When a Supplier accepts an Order and Customer requests pick-up, the pickup address will be disclosed to the Customer that placed the Order to facilitate the Customer to pick up the 3D Print at the Supplier’s location.

3.3. Our web servers collect logging and analytical information for the sole purpose of improving the Website and our Services.

3.4. We may draw up statistical and demographic data rendered anonymous and use this for performance monitoring, improvement of the Service and public relations.

3.5. The processing of your personal data is based on the following grounds:

Your consent.

The preparation or performance of an agreement with you.

Compliance with a legal obligation.

Our legitimate interests.

3.6. When we process personal data on the basis of your consent, you can always revoke your consent.

3.7. We may disclose the collected personal information if it reasonably believes that it is required to do so by law, regulation, court order or any government authority.

3.8. We can have a legitimate interest to process your personal data, namely, to resolve disputes or legal procedures or for statistical reasons, to improve our services and public relations.

3.9. We can be legally or contractually obliged to process your personal data. The processing of your personal data can also be necessary to enter into a contract with you. In these cases, we can only continue our relationship with you when you provide us with the needed personal data.

4. How Long We Keep Your Information

4.1. We do not retain your personal information for any longer than is necessary for the purposes mentioned in this Privacy Policy or in so far as such is necessary for compliance with statutory obligations and for solving any disputes.

4.2. When we process your personal information on the basis of the preparation or the performance of an agreement with you, we will store your personal information for up to seven years after our agreement has ended, or after resolving a dispute.

4.3. When we process your personal information on the basis of a legal obligation, we will store your personal information for the period which is determined by the law.

4.4. We will process your personal information for no longer than the definitive limitation period of a legal claim we may possible have against you. We store judgements between you and our company for twenty years.

4.5. When we process your personal information on the basis of your consent, we will store your personal information until you revoke your consent.

4.6. Depending on the type of cookie, we will store your personal information for a maximum of 6 months.

5. Third-Parties

5.1. We employ other parties to perform functions on our behalf. Examples include, hosting services, customer relationship management, analytics, technical reviewing services of the uploaded 3D and payment processing services. These selected parties may process your personal information only to the extent that is necessary to perform such functions on our behalf and subject to our instructions. We have procedures in place to ensure that these third-party companies value your privacy.

5.2. These parties may be located in the EU/EEA or the United States of America (“USA”). Any party employed by us that is located in the USA adheres to the Privacy Shield. This means that an adequate level of privacy protection is provided.

5.3. You may arrive at the CC3D website from another website that integrated the CC3D printing services. CC3D has no power over the websites of third-parties to which you are linked to or from. It may therefore be the case that a different privacy policy is applicable for the use of these websites of third parties. This Privacy Statement only relates to information collected through the CC3D services. CC3D does not accept any responsibility or liability for (the operation and/or contents of) websites of third-parties. Via CC3D Services you can share information about yourself with others. You yourself are responsible for the information you spread via the CC3D Services. CC3D does not accept any responsibility or liability for this.

6. Cookies

6.1. We may store some information in the form of so-called “cookies” on your device, such as your computer, to offer a more user-friendly and efficient Website and Services. A “cookie“ is a small string of information that is saved temporarily or permanently on your computer when you visit the website.

6.2. We use so-called “functional cookies” (first-party cookies), which only serve the technical operation of the Website and Services. These cookies remain on your computer after you close your browser and may be used by your browser on subsequent visits to our websites. Once you disable these cookies by means of your browser settings not all functionalities of the Website and Services are accessible.

We recognise our responsibility to protect the information you entrust to us. CC3D implements appropriate technical and organisational measures to secure your personal information against loss or against any form of unlawful processing. These measures guarantee an appropriate level of security, taking into account the state of the art and the costs of implementation, and having regard to the risks associated with the processing and the nature of the data to be protected. These measures shall also aim at preventing unnecessary collection and further processing of your personal information.

8. Your Rights

8.1. You have the right to request access, rectification, erasure, restriction, data portability and the right to object against the use of your personal information. However, we can decline your request in case we have compelling legitimate grounds which override your interests, or the processing is for the establishment, exercise or defence of legal claims.

8.2. For security reasons, we reserve the right to take steps to authenticate your identity before providing access to your personal data. We will answer your request free of charge, however reserve the right to charge a reasonable fee for carrying out your request in case your request is excessive or is manifestly unfounded.

8.3. You can send your request to exercise your right(s) to cameron@collinscreations3d.com. Be as clear and precise as possible in your email. In any case state which right you want to exercise and on what grounds. We will answer your request within one month after receipt, unless we need more time. Then we will inform you within one month after receipt of your request that we need a maximum of another two months. Within this period of time we will notify you about whether we can fulfil your request or not. In case we cannot fulfil your request, we will let you know on what ground.

9. Changes To This Privacy Policy

We may change how we collect and use personal information at any time and without prior notice, at our sole discretion.

We may change this Privacy Policy at any time. If we make material changes to the Privacy Policy, we will notify you either by posting the changed Privacy Policy on the Platform or by sending an email to you. We will also update the “Last Updated Date” at the top of this Privacy Policy. If we let you know of changes through an email communication, then the date on which we send the email will be deemed to be the date of your receipt of that email.
